TERMS AND CONDITIONS Registration is required to become a user of the US Auction Brokers website. Once you are a registered user of US Auction Brokers, you legally accept and agree to be bound by the terms and conditions described below. These terms may be updated occasionally without prior notice. You have the right to browse the site without registering, but to see and participate in the bidding, you must register, which is free of charge. REGISTRATION To register, you must be at least 18 years old. Each user agrees to provide current, complete, and accurate contact information, including name, address, phone number, and email address. Users agree to update this information upon change. All PO Boxes must include the street address. US Auction Brokers reserves the right to validate these accounts via email and/or telephone. For security purposes, if billing and shipping addresses differ, a customer may be subject to a deposit request and/or required to fill out a credit card authorization form before entering the events or upon winning bids or shipping merchandise to said customer. If contact information is incomplete, false, or inaccurate, US Auction Brokers may suspend or terminate the account. Providing false or fraudulent information is a violation of these Terms and Conditions and could subject a user to criminal or civil liability. US Auction Brokers is a private entity and reserves the right to deny access at its sole discretion for any reason whatsoever. By checking the box in the registration that you accept the terms and agreement, you are accepting a legal contract between you and US Auction Brokers. Your bid is also your agreement. NOTE: This site is open to U.S. and Canadian residents only. MERCHANDISE All items are sold on a strictly “as is” basis. Purchaser hereby assumes all risks related to the grading, quality, description, condition, authenticity, and provenance of a lot. Questions regarding the merchandise are welcome. Only bid on items whose descriptions you are satisfied with. All items and photos are thought to be accurate. US Auction Brokers does not guarantee coin grades, as numismatic grading is a complex and subjective process that may involve the interpretation and opinions of experts. US Auction Brokers is not a coin grading authority; therefore, it will not void any sale due to a difference in interpretation. Jewelry and watches are said to be as described and genuine. Exact weights, sizes, measurements, quality, and estimated auction value are not guaranteed. Certificates come from an outside source and are for informational purposes, and can vary in interpretations and estimates. Art items are guaranteed as to artist, signature, and medium. Exact measurements, conditions, and estimated values are not guaranteed. Certificates of authenticity are provided for informational purposes only. A sale cannot be voided because of various interpretations of the value of an item. BIDDING Items are listed on the site for a specified period of time and are deemed sold at the close of bidding set at a time pre-determined by US Auction Brokers. Once bidding begins, bidders may make a bid at any time before the closing of the bidding. US Auction Brokers may require a deposit for new bidders or high-volume bidding. Additionally, some high-end items require a deposit to bid. If a deposit is placed, when the user goes to place a bid, a window will show for the deposit to be made. This deposit will go toward the winning bids, and if nothing is won, it will be completely credited. Bidders are required to conduct their own research on items before bidding. We recommend that any user not satisfied with the description of an item not bid on said item. Bidding enters the user into a legally binding contract. All items will have a minimum starting bid price disclosed on the site. For certain items, the Seller may impose a reserve price, which is not disclosed on the site. US Auction Brokers reserves the right to bid on its own behalf or on behalf of the consignor up to the reserve amount on any item. If there are no bids above the minimum bid or reserve price (whichever is higher), then the Seller is not obligated to sell the Asset. After bidding closes on each Asset, US Auction Brokers will send a confirmation email to the winning bidder. The member will also be able to access his winning bids by logging on to the site and clicking the “My Account” tab. FRAUDULENT BIDDING Bidding on any item on US Auction Brokers without the intent to pay all charges associated with the item is considered fraudulent. This type of bidding is not allowed and is considered a violation of the terms of US Auction Brokers and will be subject to civil and criminal penalties. GUARANTEE AND RETURN POLICY Estimated values listed on auction items are provided for informational purposes only and are not guaranteed due to factors including, but not limited to, market fluctuations and subjectivity in quality grading. Market values are determined by the bidding process. US Auction Brokers does not guarantee coin grades, as numismatic grading is a complex and subjective process that may involve the interpretation and opinions of experts. All items are otherwise guaranteed as described. We aim to provide accurate descriptions; however, should gross discrepancies between the item and its description arise, we will gladly accept returns for a full refund. If an item is accurately described but you remain dissatisfied, we accept most returns with deductions for shipping costs and a 20% restocking fee. Requests for returns and refunds must be received within 30 days of receiving your item. Visit our FAQ page for more information about returns. SETTLEMENT OF TRANSACTIONS GENERALLY Settlement must be made within 2 days of the auction closing. Users may log in to their account and use the “My Account” tab to view invoices for winning bids. Secure payment can be made by phone or on the US Auction Brokers website using Visa, MasterCard, Discover, or American Express. Winning bidders may also elect to contact customer support to pay via telephone, request a PayPal invoice, or make arrangements to send a cashier’s check. Customers who elect to pay via credit card or PayPal are subject to a 2% processing fee collected at the time of payment. The winning bidder is responsible for paying the invoice in full, including the final bid amount, plus buyer’s premium, processing fee, shipping and handling fee, and any applicable taxes. Any invoices not paid within two days of the auction closing will be considered past due. US Auction Brokers, at its sole discretion, may choose to forward said account to the Collections department or re-offer the item for sale. SHIPMENT Once full payment is received, US Auction Brokers will ship the item(s) to the shipping address indicated during the registration process. US Auction Brokers does not ship to PO BOXES. In addition, if the shipping address is not a verified address for the form of payment being used, further written documentation will be required. Most items will be shipped within 10 business days, defined as Monday through Friday, excluding holidays, following the day of payment, unless otherwise noted. Items $5,000 and higher will require additional confirmation, for example, a credit card authorization form and a copy of the credit card used as well and a driver's license. Larger merchandise in size may take longer than usual. On rare occasions, certain contracts may require additional shipping time. Shipping and handling costs are noted in the description of each item. This fee includes shipping, handling, materials, labor, and insurance coverage. US Auction Brokers ships to the 48 contiguous states in the United States. In addition, for an increased shipping fee, we ship to Alaska, Hawaii, Canada, and Puerto Rico. We do not ship to any other countries/territories. PRIVACY All information given to US Auction Brokers for the registration and all credit card information will be kept private. GENERAL US Auction Brokers reserves the right to withdraw property from the sale for any reason and with no liability whatsoever for such withdrawal, which could take place at any time, including before, during, or after an auction. If the item is withdrawn after payment has been received, a full refund of all monies paid will be issued to the bidder. DISCLAIMERS ⚠️
